Terms and Conditions and The Right to Cancel

These Terms and Conditions and the Right to Cancel shown at the end of these terms and conditions apply to all sales of products and services supplied by The Handrail Store (thehandrailstore.co.uk)on or after 1st September 2015. These terms and conditions and the right to cancel should be read and adhered to each time a purchase is made. By placing an order and proceeding to checkout you agree to acceptance of these terms and conditions and acknowledge your right to cancel. This does not affect your statutory rights. The Handrail Store reserve the right to amend the terms and conditions at any time and you should read them prior to any purchase.

General

In these conditions of sale:

These conditions may only be modified by a variation in writing signed on behalf of the ‘Company’ by the Managing Director.

Supply of goods

The Handrail Store has a legal duty to supply goods that are in conformity with the contract and products are sold under the express understanding that:

Personal and Business Customers

Contracts for the supply of goods or services to retail or domestic customers are governed by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCIACRs) with effect from 1September 2015 and the Sale of Goods Act 1979 (as amended). Any customers contacting the ‘Company’ in the course of their business are excluded from consumer protection legislation and are contacting The Handrail Store on a business-to-business basis.

Description of Products

The customer is fully made aware of conditions of sale regarding Handrails and other products. The Handrail Store cannot guarantee that the appearance and/or the colours of products shown on this site exactly reproduce the appearance and/or colours of the physical products themselves. All sizes quoted and supplied are within a tolerance of +/- 3mm. All the information contained on thehandrailstore.co.uk is as accurate and as up to date as possible and The Handrail Store cannot be held responsible for any inaccuracies. Where a photo is shown of a particular brand of product The Handrail Store reserve the right to substitute a different brand of the same or better quality than shown.

Liability

The handling of any steel products can be dangerous and that the edges of metal can be sharp. The Handrail Store advise all customers to take all the necessary precautions concerning health and safety and use the utmost care when handling material whilst using/fitting our products. Please use appropriate personal protective equipment including but not limited to gloves, head protection and face protection (if cutting this material), to ensure safety at all times. Lengths of material The Handrail Store sell that are cut down are not de-burred. It is the customer’s responsibility to ensure that they are satisfied with the finish prior to using, fixing any of the products. In no event will The Handrail Store be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from the use of any of our products.

Quotes and Orders

The Handrail Store does take orders over the phone. If you have placed your order on the handrail Store’s website (handrailsupplies.co.uk) or over the telephone, for the avoidance of doubt , The Handrail Store will email you a confirmation of your order complete with any cutting instructions within 10 minutes of placing your order. Ordering goods & Products from The Handrail Store is a two way process between The Handrail Store and the customer. The Handrail Store(The Handrail Store) endeavour’s to ensure orders are correctly interpreted but occasionally there may be miscommunication. The Handrail Store will do its very best to ensure your order is correct but as part of the process it is your responsibility (The customer) to check the confirmation (The Handrail Store) send to you by email to ensure that you are satisfied and notify us within 2 hours of any changes required. If you have not notified us within 2 hours of your order being placed it is deemed that the order is correct and The Handrail Store cannot be held responsible if your order is incorrect. Should The Handrail Store send you a shopping cart quotation or an email with a quote on, it is the customer’s responsibility to ensure that The Handrail Store has interpreted your requirements correctly. If you have received a shopping cart quote which may or may not include cutting instructions and you have paid online, once you have paid for your items it is deemed that you have accepted our recommendation and The Handrail Store will not be liable for any claim for incorrect sizes or cutting.

Errors & Omissions

Should The Handrail Store have inadvertently listed a product at the incorrect price due to an input error or an error in pricing from a stockholder or supplier The Handrail Store reserve the right to change or amend this price and to withdraw, cancel or refuse orders even if the order is confirmed. Should this be the case The Handrail Store will always contact you to inform you and advise you of the correct price. If you no longer wish to purchase the goods and have already paid for the product The Handrail Store will refund your purchase by the same method as the original payment was made.

Ordering and Payment

All orders with the exception of special items, made through The Handrail Store should be paid for by debit card, credit card, or PayPal. Should you order or any special items you will be sent an invoice by email, which can be paid through PayPal who accept all credit and debit cards. Once The Handrail Store have received payment confirmation from our Bank your order will be processed. The Handrail Store can also accept payment by the following methods; BAC’s; you will need to contact us on handrailsupplies.co.uk. for details. Once The Handrail Store has received confirmation from our bank that the payment has been received The Handrail Store will dispatch your goods. Cheque; if payment is made by cheque you should be aware that there is a 7 day lead time from receipt of your cheque. The Handrail Store will not release the goods for dispatch until The Handrail Store have received confirmation from our bank that your cheque has cleared. Please note The Handrail Store are unable to accept PayPal payments for any products that are to be collected.

The Handrail Store advises all customers that The Handrail Store do not store any credit/debit card details or any financial information supplied to us once the customer has paid for an order.

Availability

Should for any reason the product not be available for immediate delivery The Customer will be contacted with an estimated date of delivery. Should the date not be acceptable and The Customer wish to cancel the order and the customer has paid, The payment will be refunded including any delivery charges (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). Refunds are made by the same method as the original payment was made.

Delivery

All goods & Products are delivered to the address stated at the time of ordering. The Handrail Store aims to deliver your goods if they are in stock as soon as possible within approximately 2 to 3 working days (this is only an estimate and may be sooner or no more than 30 days after you have placed your order).The Handrail Store’s products are sent out in good faith and occasionally goods are misrouted, lost in transit or may be subject to delays beyond The Handrail Store’s control. If the contents of your parcel are for installation on site, The Handrail Store does not recommend you schedule any work until you have received the goods. The Handrail Store will not be held responsible or be liable for any compensation for any losses, damages, charges or expenses as a result of any delay of delivery. Standard delivery is between 8.00am to 5.30pm Monday to Friday. Standard delivery includes our free delivery service. If The Handrail Store do not have your item(s) in stock or our stockholders are out of stock there may be a delay of up to 30 days. Should this be the case The Handrail Store will contact you by the email address you provided at the time of ordering and advise you accordingly. If the delay is significant you will have the option of cancelling your order and any payments including any delivery charges (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), will be refunded. The Handrail Store will not refund the original delivery cost or the cost of us delivering the goods if you received free delivery. Refunds are made by the same method as the original payment was made. *Important information regarding same day shipping for tube clamp & galvanised tube.Providing The Handrail Store has the goods in stock The Handrail Store will do our very best to ship any orders received before 11am on the same day but The Handrail Store is unable to guarantee this service. The Handrail Store would also advise all customers that due to the volume of orders received on a weekend it may not be possible to ship orders placed on a Monday, even if the order is placed before 11am.

Delays

As with all deliveries, occasionally your parcel may be subject to delays beyond our control. If the contents of your parcel are for installation on site, The Handrail Store do not recommend you schedule any work until you have received the goods. The Handrail Store can not be held responsible or be liable for any losses, damages, charges or expenses as a result of any delay of delivery.

Force Majeure

The Handrail Store is not liable for any delay of your order due to circumstances beyond our control. These include but are not limited to an act of God, war, terrorism, strikes, trade disputes, breakdown of equipment, fire, flood, explosion, earthquake, civil disturbance, riots, accidents, storm, shortages, difficulty in obtaining material, disruption to energy supplies, telephone supplies, road traffic problems, severe weather conditions.

Receipt of goods

All packages are thoroughly wrapped before leaving our premises and are delivered to you by our carriers. All goods must be signed for on receipt. If you do not sign for the goods The Handrail Store cannot accept any responsibility for loss or damage. Once the goods have been signed for The Handrail Store accept no responsibility for any loss or damage as the goods are now in your possession. Please check your package carefully, should your goods be damaged or items are missing the delivery note must be signed DAMAGED or MISSING ITEMS. If this is the case you should contact us as soon as possible, so The Handrail Store can resolve any queries, either by email on sales@thehandrailstore.co.uk or on our telephone support number 01903 20 25 30. All claims for damaged or missing items must be submitted within 7 days of delivery or all goods will be deemed to have been delivered in good order. Please also note the following:

  • If the goods are delivered damaged The Handrail Store may require evidence of the damage, e.g. photographs before The Handrail Store replace the goods or make a refund. Please contact Customer Services on 01903 20 25 30 to discuss.
  • If your goods are delivered damaged The Handrail Store will replace them or make a refund providing that the goods have not been used. If the goods have been used they will be deemed fit for purpose and The Handrail Store reserve the right not to replace or make a refund.
  • If your goods are delivered damaged The Handrail Store reserve the right to collect the damaged goods from the delivery address stated on your order.
  • If the goods are to be collected this may be on a different day to any replacement goods being delivered.

Redelivery

If your package is returned to us undelivered, The Handrail Store will not be held responsible or be liable for any compensation for any losses, damages, charges or expenses as a result of any delay of delivery. The Handrail Store may charge to redeliver the parcel to you.

Collection

If you would like to collect your goods from us to save on carriage costs, please contact us first before making any journey to ensure your goods are ready to collect. The Handrail Store cannot be held responsible if you arrive and the goods are not ready. Please note that goods paid for through PayPal cannot be collected. The Handrail Store would also advise you that unless goods have been paid for prior to collection any cutting required will not be carried out until you arrive and the goods are paid for. Therefore, you may have to wait for your order.

Faulty or Wrong products

Please be aware that all our packages are quality control checked before leaving our premises to ensure any potential problems are minimised. Should you be in the unfortunate situation that you have received the wrong goods or they are faulty, please contact Customer Services on 01903 20 25 30 or by email on sales@thehandrailstore.co.uk All faulty goods should be returned to us within 7 days of receipt of your order. Please contact Customer Services by email on sales@thehandrailstore.co.uk before returning any goods to obtain a returns number. Please also note the following:

  • If the goods are delivered damaged The Handrail Store may require evidence of the damage, e.g. photographs before The Handrail Store replace the goods or make a refund. Please contact Customer Services on 01903 20 25 30to discuss.
  • If your goods are delivered damaged The Handrail Store will replace them or make a refund providing that the goods have not been used. If the goods have been used they will be deemed fit for purpose and The Handrail Store reserve the right not to replace or make a refund.
  • If your goods are delivered damaged The Handrail Store reserve the right to collect the damaged goods from the delivery address stated on your order.
  • If the goods are to be collected this may be on a different day to any replacement goods being delivered.
  • The Handrail Store will not be held responsible and no compensation claims will be entered into for any non-collection, missed collection or no-show by our couriers.

Returns

The Handrail Store will refund or exchange an item, providing that:

  • All returns MUST be made within 14 days of receipt of goods.
  • If you wish to return an item for any reason except being faulty or The Handrail Store have sent the wrong goods The Handrail Store will only accept items that are on our current stock list. Any steel that has been specially cut to your size/requirements cannot be returned.
  • If you wish to return an item to us please contact Customer Services on 01903 20 25 30 or on sales@thehandrailstore.co.uk BEFORE returning any item, who will discuss this with you.
  • The Handrail Store are sorry but The Handrail Store cannot accept returns of specially made items i.e. Bespoke Handrails as these have been made to your design.
  • Please be aware that should you wish to return an item for any reason other that it being faulty or The Handrail Store have sent the wrong goods you will need to arrange for the goods to be returned to us either by post or courier and this will be at your own cost. The Handrail Store appreciate it may be difficult to arrange to return some longer lengths of metal, (i.e. over 3m long) and in these circumstances The Handrail Store may be able to arrange collection by our couriers at your cost. However, please note that The Handrail Store will not be held responsible and no compensation claims will be entered into for any non-collection, missed collection or no-show by our couriers.
  • If you paid for your original delivery The Handrail Store will refund the original delivery cost to you (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). The Handrail Store will not refund the original delivery cost or the cost of us delivering the goods if you received free delivery.
  • Any items to be returned should be in the original packing and be unused. The Handrail Store will not accept any items that have been used, cut, damaged and are not in a re saleable condition.
  • The Handrail Store reserve the right to recover any amount up to the contract price of any items returned to us in a damaged state or if the value of the goods is diminished by any amount as a result of you handling the goods beyond what is necessary to check the nature, characteristics and functioning of the goods.
  • All returns must show on the outer packaging our returns number. Our Customer Services team will give this to you.
  • Any refund will only be made once The Handrail Store are in receipt of the goods or you have supplied evidence of having sent the goods back whichever is the earliest. Any refunds are made by the same method as the original payment was made. The Handrail Store aim to process your refund as soon as possible but this will be within 14 working days of receipt of the returned goods or if earlier 14 days after the day you provide evidence that you have returned the goods.
  • The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCIACRs) form part of our refund/exchange policy. If the product you ordered is no longer required and provided that The Handrail Store have not personalised these goods by cutting them down to your specific sizes, this allows you to cancel your contract with us within 14 working days of receipt of the goods. This only applies to transactions that are not Business-to-Business. If the goods are not required you will need to arrange for the goods to be returned to us either by post or courier and this will be at your own cost. The Handrail Store appreciate it may be difficult to arrange to return some longer lengths of metal, (i.e. over 3m long) and in these circumstances The Handrail Store may be able to arrange collection by our couriers at your cost. However, please note that The Handrail Store will not be held responsible and no compensation claims will be entered into for any non-collection, missed collection or no-show by our couriers. Please see Your Right to Cancel section shown at the end of these terms and conditions.
  • This refund policy does not apply to sourced goods, please the Sourced Goods Section for further information.

Goods lost in transit

Please allow 7 working days for goods to be delivered once you have been notified that they are in transit to you. If after this time you have still not received your goods, please contact us within 7 days of the expected delivery date for us to investigate. Should you not contact us by email on sales@thehandrailstore.co.uk within this time frame, it is expected that the goods have been delivered in good order and no claim will be entertained.

Sourced Goods

The Handrail Store will source any goods you request of us by using our contacts within the industry. Any goods supplied by us will be under contract and a quantity and price will be agreed by both parties before any orders are placed with our suppliers or accepted. In this situation should the goods be faulty The Handrail Store reserve the right to negotiate with our supplier before any credits are agreed with our customer. This may be outside the 14 day time frame stated in these terms and conditions but The Handrail Store will do everything possible to keep time limits to a minimum. Any special sourced goods are non-returnable unless the product is faulty.

The Handrail Store appreciate that ordering goods is a two way process between our customers and The Handrail Store. The Handrail Store endeavour to ensure orders are correctly interpreted but occasionally there may be miscommunication. The Handrail Store will do our very best to make sure your order is correct but as part of the process The Handrail Store also ask you to check the confirmation The Handrail Store send to you by email to ensure that you are satisfied. The Handrail Store cannot be held responsible if you do not inform us immediately of any changes prior to us placing any orders with our suppliers.

Customer Services/Complaints

The Handrail Store pride ourselves on our Customer Service and The Handrail Store are available during office hours to speak to if you have a query, are not sure of the product you need or you have any comments or cause for complaint. The Handrail Store aim to resolve all queries/issues within 24 hours but please appreciate sometimes this may take slightly longer. The Handrail Store will help to resolve any problems you may have on delivery issues, payments or ordering on our website. Right To Cancel

  • The Handrail Store can only accept cancellation of goods that are on our current stock list. Any metal that has been cut to your personal requirements/size cannot be returned.
  • The Handrail Store cannot accept cancellation of specially made items, i.e. laser cutting or plasma cutting as these have been made to your personal requirements.
  • The Handrail Store cannot accept cancellation of any special sourced goods. Please see the sourced goods section in our terms and conditions for further information.
  • This cancellation period will expire after 14 days from the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the goods.
  • To exercise the right to cancel you must inform us, of your decision to cancel this contract by a clear statement, in writing either by:
  • post to Apt 1 Christ Church Hall, 78 Portland Road, Worthing, West Sussex. BN11 1QG,
  • or by email at sales@thehandrailstore.co.uk
  • You may use the model cancellation form shown at the end of this information if you wish to do so but this is not obligatory.
  • To meet the cancellation deadline it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

  • If you cancel this contract The Handrail Store will reimburse to you all payments received from you including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). The Handrail Store will not refund the original delivery cost or the cost of us delivering the goods if you received free delivery.
  • The Handrail Store may take a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of any unnecessary handling by you; other than any handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
  • The Handrail Store will make the reimbursement without undue delay, and not later than:

o 14 days after the day The Handrail Store receive back from you any goods supplied, or

o if earlier, 14 days after the day you provide evidence that you have returned the goods or

o if there were no goods supplied, 14 days after the day on which The Handrail Store were informed about your decision to cancel this contract.

  • The Handrail Store will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event you will not incur any fees as a result of the reimbursement.
  • The Handrail Store may withhold reimbursement until The Handrail Store have received the goods back or you have supplied evidence of having sent the goods back whichever is the earliest.

Returning Goods

  • You shall send back the goods or hand them over to us at Apt 1 Christ Church Hall, 78 Portland Road, Worthing, West Sussex. BN11 1QG, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
  • You will have to bear the direct cost and arrange to return the goods by post or courier.
  • If the goods by their nature cannot be returned by post you will need to arrange their return by courier and this will be at your own cost. The Handrail Store appreciate it may be difficult to arrange to return some longer lengths of metal, (i.e. over 3m long) and in these circumstances The Handrail Store may be able to arrange collection by our couriers at your cost. However, please note that The Handrail Store will not be held responsible and no compensation claims will be entered into for any non-collection, missed collection or no-show by our couriers.
